Work permit

Permission for recruitment of foreign workforce (hereinafter - Work permit) is a legal ground of hiring a foreign citizen. Procedure of work permit obtaining has undergone a number of innovations in 2017, aimed at the liberalization of this administrative barrier.

Work permits are issued by the local executive authority of relevant region based on recommendations of Commission on issue of permissions for recruitment of foreign workforce within the quota allocated by the competent employment authority.

When issuing the work permit education in relevant field and professional experience are taken into account. At the same time, it is imperative for employers to adhere to workers’ proportional ratio – foreigners and workers – citizens of the Republic of Kazakhstan (70% of citizens of RK and 30% of foreigners for foreign employees of 1 and 2 categories and 90% of citizens of RK and 10% of foreigners for foreign employees of 3-4 categories) except for some business entities.

Work permit is issued within 7 working days from the date of documents submission. However, in practice the whole process of obtaining a work permit takes much more time, as a work permit is issued only if there is no alternative in the local labour market. Confirming that requires additional time.

In case of positive consideration of the application, employer is obliged to pay the state fee starting from KZT 310 853 to KZT 510 525 depending on employee’s category and employer’s business sector, except intra-corporate transfer. Further, employer and the competent authority agree on special conditions that are binding for the employer (professional training, professional retraining, advanced training or creating additional working positions).

The validity of a work permit is 12 months with possible extension depending on employee’s category and employer’s compliance with established requirements.

Meanwhile, laws of RK provide a number of exemptions from obligation to obtain work permit for recruitment of foreigners in prioritized and specific sectors (heads of branches and representative offices, IFC “Astana”, educational institutions, etc.).
